1. ABOUT US
Borngate, Limited Liability Company (hereinafter – SIA Borngate), registered in the Republic of Latvia under No.: 40103491374, VAT Reg. No. LV 40103491374, Registered Address: Riga, Hospitāļu iela 40-2, LV-1013, bank: Swedbank A/S, HABALV22, account: LV27HABA0551032331571, (hereinafter – the Seller).
The procedure of shopping at the Internet store www.ripot.lv is governed by Cabinet Regulations of the Republic of Latvia No. 207 (28 May 2002) “Regulations on Distance Contract”.
2.1. RIGHT OF WITHDRAWAL AND PRODUCT RETURN
The right of withdrawal is the right by exercising which you can unilaterally resign from the distance contract (to withdraw an order) within a particular term without paying a contractual penalty, interest or reimbursement of damages. You may use the right of withdrawal and to resign unilaterally from the contract within 14 (fourteen) calendar days. The term of use of the rights of refusal is counted from the date when you have received the goods or a part of goods. You have the right to withdraw within 14 calendar days and to return the goods to the Seller. In case of return of the goods, the entire payment made for the goods is returned.
Sending of a rejection within the stipulated term of 14 days as from the date of receipt of the goods terminates the contract and releases you from any contractual obligations, except the fees related to return of the goods or an item to the manufacturer, the Seller or the service provider. If you use the right of withdrawal to return the goods within 14 days, you cover all the costs related to the delivery. Prices of goods are stated in EUR, including the VAT 21%.
By using the right of withdrawal referred to in the present terms, you are liable for any reduction of the value of the goods, as well as for maintaining the quality and safety of the goods during the term of exercising the right of withdrawal. The Seller has the right to refuse repayment of any paid amount for the goods, before you have returned the goods or if, upon receipt of the goods, the Seller finds out that it has been used or does not conform to 100% selling condition and look, is not in the original packaging with all the documents attached (if such documents were attached). You are liable for damages to products occurring during the return of the goods. Goods should be returned in full set and in the original packaging, as well as without any visual damage (scratches, damaged packaging, etc.) - in the contrary case the Seller has the right to refuse acceptance of return of the goods. At starting use of the purchased goods you confirm that it conforms to the order and can no longer be returned. Descriptions and pictures of goods are provided for information only.
You are obliged to return the goods within 7 (seven) days following sending of a written withdrawal. The Seller is obliged to repay the amount of money paid for the goods until termination of the contract immediately, however, latest within 30 days as from receipt of the buyer’s written withdrawal.
You are obliged to deliver the goods to the Seller within 7 (seven) days following sending of the withdrawal (see the withdrawal form here) to the store address: store Ripot.lv, Lienes iela 12, Riga. The Seller is obliged to repay the amount of money paid for the goods until termination of the contract immediately, however, latest within 30 days as from receipt of the buyer’s withdrawal form.You have lost the right of withdrawal if you have opened the packaging of the goods or failed to notify exercising of the right of withdrawal within 14 days as from the date of receipt of the goods.
2.2. RIGHT OF RETURN OF THE GOODS
The terms of return of the goods include the legal provisions arising from Directive of the European Parliament and Council 97/7/EC on the protection of consumers in respect of distance contracts and the Law of the Republic of Latvia “Law on Protection of Consumer Rights”.
You are not obliged to accept goods if they have been ordered without you placing the order.
Goods do not conform the to contract terms if they do not conform to the requirements defined by laws and regulations, as well as usually imposed requirements; it is not suitable for purposes for which goods of the same name and description are usually used for; it does not conform to the characteristics or its assembly does not conform to the assembly presented by the Seller during conclusion of the contract or presentation of the offer; misleading, false information has been provided about them or no information has been provided and therefore the goods cannot be used for the intended purpose; they are damaged (the goods have got outside the intended packaging, the internal or external packaging is clearly damaged).
If the goods not compliant with the Contract terms have been sold or provided for use to you, you have the right to send an e-mail to firstname.lastname@example.org and request the Seller to perform one of the below: to replace the goods with the same or equivalent goods ensuring compliance with the Contract terms; to cancel the contract and to repay the amount of money paid for the goods.
The goods should be replaced or their non-conformity to the Contract terms should be eliminated free of charge (including without reimbursement of the costs of sending the goods and other costs) and within a reasonable term without causing any inconvenience to you.
If the non-conformity to the Contract terms is minor and cannot substantially affect your possibilities to use the goods, you cannot request the Seller to cancel the contract and to repay the amount of money paid for the goods. If the Seller cannot perform the contract because the ordered goods are not available, it will notify you thereof and will repay the full payment made by you latest within 30 calendar days as from the date when the Seller received your order.
Processing of the website data is performed by SIA Borngate. The personal data processing objective is to provide registration and authorisation of clients, provision of trade and delivery services and sending of required information. Personal data processing is carried out in compliance with Section 7.1 of the Law on Protection of Personal Data and in accordance with the Directive of the European Parliament and Council No. 95/46/EC on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

We will not process or store your bank or payment card details used when purchasing goods and services through Ripot.lv.
Payments for purchases will be completed through third-party payment platforms.
SIA Borngate is obliged to disclose personal data in the cases provided by the law to state and local government officials, as well as to disclose the client’s personal information when it is requested by the law. SIA Borngate implements all reasonable measures for security of personal data in order to protect it against theft, loss, misuse, as well as unauthorised access, disclosure, modification and damage. If a client who has ordered and purchased goods at the webstore www.ripot.lv lacks legal capacity, the legal representative (for instance, parents, custodians) is responsible for the order of the goods and payment thereof. In the above case the order cannot be withdrawn and made payment for the purchase cannot be repaid. You as a client consent to personal data processing.
4. TERMS OF DELIVERY
The order will be delivered according to the information specified in the order. Delivery costs of the goods depend on the type of delivery of the goods and the delivery address. The delivery fee is 10 euro for purchases up to 50 euro. The delivery fee of purchases above 50 euro is 5 euro in the entire territory of Latvia. Orders can also be received at the store at Riga, Lienes iela 12 free of charge. Within the territory of Latvia, Lithuania and Estonia the order will be delivered within 1-2 business days following receipt of the product. Deliveries outside the borders of Baltic states usually take 1-2 weeks. 5. PAYMENT PROCEDURE
Following placement of an order, an invoice will be sent to the e-mail address you have specified and it is recommended to pay it within 2 business days. We offer the possibility make payments with VISA and MASTERCARD payment cards, as well as the possibility to make payment by using PayPal which is among the most popular and safe global electronic payment systems. All the textual information and graphic images presented on the website www.ripot.lv is the property of the Seller (SIA Borngate) or/ and its suppliers. Re-publishing, any presentation, dissemination (including translations) of the materials on the website www.ripot.lv is only permitted with the written authorisation of the Seller (SIA Borngate). 7. RESOLUTION OF DISPUTES
If a dispute arises in relation to the concluded distance contract and use of the website www.ripot.lv, all the rights and obligations provided by the present terms and conditions, as well as all the actions within this scope are governed by the legislation of the Republic of Latvia according to the scope as if the present terms and conditions would be a contract fully concluded and performed in Latvia. The parties hereby confirm that they will strive to resolve all the disputes related in any way to visiting the website www.ripot.lv or arising in relation to performance of the present distance contract, its explanation or termination by mutual negotiation. If the parties cannot resolve a dispute by friendly negotiation, they submit all the disputes, disagreements or claims for resolution to a court of the Republic of Latvia. If a dispute arises between the parties as to whether the terms contained by the concluded contract are unfair, either of the contract parties has the right to apply to the court defined by the present clause, and you have the right to apply to the Centre of Protection of Consumer Rights. If a dispute arises between the parties on the matters of protection of personal data, either of the contract parties has the right to apply to the court defined by the present clause, and you have the right to apply to the State Data Inspectorate.
8. PAYMENT TERMS
The payment currency on the site is Euro. A purchase can be paid for by choosing among the following payment methods:
- Internet bank payments and Visa/MasterCard card payments provided by the payment platform www.paysera.com by using Personal data required for making payments are transferred to the licensed payment platform www.paysera.com;
- Bank transfer;
- In case at receiving the goods.
The present contract enters into force as from the moment of a successful payment to the bank account of the webstore. If it is not possible to perform the order due to any reason, the Buyer will be notified thereof and the paid amount will be returned as soon as possible, however, latest within 14 days following receipt of the notice
9. OTHER PROVISIONS
At the moment of making a purchase by using the website www.ripot.lv, you attest that you agree to the present terms and conditions, including that you agree that the present terms and conditions form the entire current agreement concluded by and between you and the Seller regarding use of the website www.ripot.lv and its content by you.
The Seller has the right to amend and update the present terms at any time by publishing relevant amendments on the website and stating the dates of making the last amendments. Any amendments made to the present terms and conditions enter into force immediately following their publication. You agree that, by continuing using of the website following implementation of such amendments, you confirm your agreement to all the amendments.
